Our registered company number is 9880980 and we are located at The Digital Media Centre, County Way, Barnsley, South Yorkshire S70 2JW. We are registered with the Information Commissioner’s Office in the UK and our ICO registration number is ZA279901. For the purposes of the Data Protection Act 2018 and the General Data Protection Regulation (GDPR), the data controller is KMF Training & Consultancy Ltd.


Our Courses and offerings

The images of the Courses as presented on our Site (consisting of online training courses and associated materials) are set out for illustrative purposes only.

We provide telephone support to customers between the hours of 9am and 5pm (UK time) Mondays to Fridays excluding UK bank holidays. Outside of these hours an email service is available.

The copyright and all other intellectual property rights in our Courses, the content of them and associated materials is owned solely by us and other contributors under licence and you may not copy or reproduce any part of them unless you have obtained a licence or other written permission from us. We only supply the Courses for internal use by you or others within your business or organisation, or to organisations by agreement, you agree not to use them or permit them to be used for any resale or other distribution purposes

KMF Training work in collaboration with other businesses and subject matter experts to create training content. One of our collaborators is Ann Gravells Ltd. Please note that the course content and its downloadable resources are copyright Ann Gravells Ltd and that you will not not forward, resell, redistribute, give away or include the resource items in any publication or publicly available website or platform. These terms of use apply to all downloadable resources created by Ann Gravells as part of the online modules - Ann Gravells terms of use


How we use your personal information

Agreements

You hereby confirm that you have sufficient authority to use our services either as an individual or a representative of an organisation.

You acknowledge and agree that in entering into this Agreement you do not rely on any statement, representation, or warranty (even if made innocently or negligently) that is not set out in these Terms and Conditions.

You will be able to purchase online content through our website and the process of such will be easy to follow.

You will receive an acknowledgement of the order being placed via email.

Delivery of any online courses will be done by way of sending you access details such as a link to our Learning Management System (LMS) and a password. You must keep this password private and not share this with anyone.

Prices for our courses will be as stated on our website and will be inclusive of VAT.

When you have purchased a course your access to the course will cease after 3 months whether you have finished the course or not. If you require longer access to the course please contact KMF Training to discuss this. There may be an additional access fee to do this. 

If you have completed the course fully you will be removed from the course access, even if this date is before 3 months


How to Pay KMF Training

You can pay for courses and services on our website with a debit and credit card via PayPal.


Communications

We will endeavour to respond to customer and client queries via email with 48 hours of receipt during Monday- Friday and the first working day after a weekend or public holiday.


Your right to cancel

You have a legal right to cancel an Agreement under the Consumer Agreements (Information, Cancellation and Additional Charges) Regulations 2013 during the period of 14 days after the date you receive a Confirmation Email from us. This means that during this period if you change your mind or decide for any other reason that you do not want a Course, you can advise us of your decision to cancel the Agreement and receive a refund provided that you first return to us any certificates which may have been issued by us.

You will only be eligible for a refund during the period of 14 days after purchase as long as you have not accessed or completed the course.


Acceptance of terms

Your access to and use of the KMF web site (www.kmftraining.co.uk) ("the Website") is subject exclusively to these Terms and Conditions. You will not use the Website for any purpose that is unlawful or prohibited by these Terms and Conditions. By using the Website you are fully accepting the terms, conditions and disclaimers contained in this notice. If you do not accept these Terms and Conditions you must immediately stop using the Website.


Advice

The contents of the Website do not constitute advice and should not be relied upon in making or refraining from making, any decision.


Changes to website

KMF reserves the right to:

a) change or remove (temporarily or permanently) the Website or any part of it without notice and you confirm that KMF shall not be liable to you for any such change or removal; and

b) change these Terms and Conditions at any time, and your continued use of the Website following any changes shall be deemed to be your acceptance of such change.


Links to third party websites

The Website includes links to third party websites that are controlled and maintained by others. Any link to other websites is not an endorsement of such websites and you acknowledge and agree that we are not responsible for the content or availability of any such sites.


Copyright

a) All copyright, trademarks and all other intellectual property rights in the Website and its content (including without limitation the Website design, text, graphics and all software and source codes connected with the Website) are owned by or licensed to KMF or otherwise used by KMF as permitted by law. b) In accessing the Website you agree that you will access the content solely for your personal use and that you will not re-use or repackage any content for commercial purposes. None of the content may be copied, reproduced, transmitted, stored, sold or distributed without the prior written consent of the copyright holder. This excludes the downloading, copying and/or printing of pages of the Website for personal, non-commercial use only.


Disclaimers and limitation of liability

a) The Website is provided on an "AS IS" and "AS AVAILABLE" basis without any representation or endorsement made and without warranty of any kind whether express or implied, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy. b) To the extent permitted by law, KMF will not be liable for any indirect or consequential loss or damage whatever (including without limitation loss of business, opportunity, data, profits) arising out of or in connection with the use of the Website. c) KMF makes no warranty that the functionality of the Website will be uninterrupted or error free, that defects will be corrected or that the Website or the server that makes it available are free of viruses or anything else which may be harmful or destructive. d) Nothing in these Terms and Conditions shall be construed so as to exclude or limit the liability of KMF for death or personal injury as a result of the negligence of KMF or that of its employees or agents.


Severance

If any of these Terms and Conditions should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction then such Term or Condition shall be severed and the remaining Terms and Conditions shall survive and remain in full force and effect and continue to be binding and enforceable.


Indemnity

You agree to indemnify and hold KMF and its employees and agents harmless from and against all liabilities, legal fees, damages, losses, costs and other expenses in relation to any claims or actions brought against KMF arising out of any breach by you of these Terms and Conditions or other liabilities arising out of your use of this Website.


Governing law

These Terms and Conditions shall be governed by and construed in accordance with the law of England and you hereby submit to the exclusive jurisdiction of the English courts.
